Terms and conditions
1.The employer/promoter will obtain all necessary permits and consents that apply to conduct the function and all matters relative to the function and will comply with all conditions imposed in connection with the granting of any such permit or consent and in particular, will ascertain and satisfy the requirements of the police force as to police supervision during the engagement.
2.The employer/promoter will provide a proper number of security personnel to ensure sufficient supervision of the venue and to prevent the entry of undesirables and ensure proper conduct of the audience, the safety of the performer and the preservation of order and will ensure that the performer is provided with a safe and secure area in which to perform and store equipment. Should the performer in their sole discretion consider that the area in which they are to perform is unsafe because of lack of shelter from the elements, including wind, rain and extremes of heat or cold or other adverse conditions, or for any other reason whatsoever, the performer may require that the employer makes the area safe or makes available another area that is safe. The decision of whether the area is safe for performance shall be solely that of the performer. If the employer fails to make the area safe or make a safe alternative available the performer shall not be obliged to perform but the total fee nevertheless shall remain payable.
3.The employer/promoter will provide safe access to the area of performance, and will also provide access to safe, sufficient power supply outlets or generating system, supervised and operated by a qualified person. The employer/promoter will also indemnify the performer/agent for any loss or damage or injury arising through malfunction thereof.
4.The employer/promoter will indemnify the performer against any loss or damage, actual or consequential of whatever kind arising wholly or in part from the default of the employer in complying with these conditions or from any trespass, negligent act or omission of the employer, his/her agent or any person under his/her supervision, direction or control.
5.(a) The employer/promoter may cancel this booking by delivery of written notice to the performer or their management not later than thirty days before the date set for the performance whereupon the employer will forfeit the deposit. The performer will be entitled to full payment if terminated by the employer in any other manner.
(b) The performer may cancel this booking for any reason whatsoever by delivery of written notice to the employer at the address herein not later than fourteen days prior to the performance date. In the event of illness, act of God, riots, labor disputes, epidemic, failure of transportation or any other event beyond their control, the performer or agent shall not be liable in any way for any loss of any kind suffered or incurred by the employer/promoter. Upon cancellation of the performance by the performer or their management or agent the deposit shall be refunded.
6.The performer or their agent/management shall not in any way be held liable for any default under this agreement, negligent act or omission.
